Overview
Charging
The laying of formal criminal charges is the official threshold where police allegations transition into an active court prosecution.
Once law enforcement determines there is sufficient evidence, an Information is sworn before a justice of the peace, formally charging you with an offence. This moment fundamentally changes your legal standing and sets the formal court process in motion. Acting decisively at the charging stage allows your defence team to review the sworn allegations immediately, ensure proper release conditions are established, and begin building a proactive strategy to counter the Crown’s case.
